Harry S. Cohen & Associates

If you or someone you love were seriously injured by medical malpractice, wouldn’t you want to be represented by attorneys who have a wealth of experience handling medical malpractice cases? At Harry S. Cohen & Associates, P.C, our attorneys focus exclusively on medical malpractice. We are committed to providing high quality, responsive legal service to patients and families who have been injured or wronged by medical malpractice. We pride ourselves in bringing justice to those who need it most.

For nearly two decades, we have been standing up for the rights of patients and getting impressive results. Due to our attorneys’ vast experience in the area of medical malpractice, we understand the legal strategies that physicians, hospitals, and their insurance companies use to deprive deserving individuals of the compensation rightfully due to them. Our attorneys use this knowledge to better help our clients obtain the compensation they deserve.

At our law firm, we associate with a wide network of medical specialists and other medical malpractice lawyers who strengthen our clients’ cases with their medical knowledge and experience. Our attorneys and medical staff have developed a reputation as skilled negotiators and effective litigators. Our attorneys thoroughly prepare every case and we work hard to achieve maximum results. If a settlement cannot be reached, we will not hesitate to take your case to trial if that is the best way to achieve the desired result in your case. We have not lost sight of the importance of one-on-one contact with our clients, and we always provide a professional and personable environment in which clients can feel comfortable and rest assured that their legal needs are being correctly addressed by an experienced attorney. Our Experts

Our firm has done plaintiff medical malpractice cases for twenty years, concentrating almost exclusively on these cases for over a decade. We will leave no stone unturned in our quest to find the most qualified expert to answer the medical questions unique to your client’s case. We spend hundreds of hours each year reviewing medical literature, identifying medical experts in many specialties and researching those same experts to insure that they are truly qualified and will testify well. We have developed a large database of reliable experts we have used and cross examined and we maintain contact with readily available experts available to review new cases.

Rely on our experience and knowledge to ask the right questions of the right expert at the right time in the life of each case. As a rule, we use only out-of-state experts to review cases or prepare for trial because local physicians are always at risk of being “turned” or “black-balled” by peer pressure. We do not use “friends” or local physicians for confidential reviews. Local physicians generally refuse to testify in court rendering the case without a needed expert late in the life of a case. We have extensive experience litigating and lecturing on the new “Certificate of Merit” rules for Pennsylvania and the expert rules peculiar to West Virginia and Ohio. Let us navigate the maze of those experts that are qualified to testify in certain states and those that are not. Approximately one quarter of the successful cases on our results pages came to us as a referral and resulted in fees for the referring attorneys.

Referrals

A regular source of our cases is by referral from lawyers in the Pittsburgh and surrounding areas, including West Virginia and Ohio. Many of our referring lawyers are themselves trial lawyers who may seek the concentrated expertise our firm offers, particularly in the area of birth injury and other complex medical malpractice issues.

Our Referral Policy: We typically advance all litigation expenses and every referral fee is dictated by the specific circumstances of each case. We have paid millions of dollars in referral fees. The Pennsylvania Rules of Professional Conduct do not limit referral fees by the degree of input from the referral lawyer and all ethical referral fee arrangements are vigorously protected. We have never encountered any dispute about a referral fee in our firm’s history. Our referral fees do not increase the fee for the client. All referral fees are taken as a percentage of our firm’s fee agreement with the client or from the referral lawyer’s fee agreement with the client. After initial contact with a referring attorney, we will never contact a potential client without the referring attorney’s permission.

How We Handle The Referral: We value the relationships with our referral attorneys and work closely with them. We strive to keep our referring attorneys updated on their files and to keep our mutual clients content and well served. We give every case individual attention. We treat each case as a new challenge both medically and legally—because they are. While we have experience reviewing thousands of medical malpractice cases and have successfully pursued many, we continue to recognize that each case is unique and requires specific client attention and new medical research and presents new issues for our expert witnesses. We work diligently to understand the medicine in each case and review the best medical schools across the nation to hire the best experts for your case. We will perfect the legal claims necessary to create a successful case and the best legal theory to make your client whole. We have extensive and varied experience in both state and federal trial courts in Pennsylvania, West Virginia and Ohio as well as and appeals courts in each jurisdiction.
