Birth Injuries

Sometimes, during labor or delivery, complications arise in which the baby suffers a physical injury. In some cases, medical malpractice is involved.

What causes a birth injury?

A birth injury can occur in many different ways, but they usually happen because of improper prenatal care or during the delivery. Cerebral palsy or other types of birth injuries can occur if a doctor or nurse fails to recognize or is slow to respond to the signs of fetal distress, or indications that the baby is in trouble. Also, a birth injury can occur with a difficult birth if the doctor fails to recognize the size and presentation of the baby.

Conditions that may be associated with a difficult birth include, but are not limited to, the following:

  • Cerebral Palsy
  • Shoulder Dystocia
  • Stillbirth
  • Preeclampsia, Toxemia and Gestational Diabetes
  • Separated Placenta
  • Delayed Caesarian Section
  • Forceps Injury
  • Failure to Diagnose Pre-term Labor
  • Maternal Infection
  • Surgical Error during pregnancy

How the injury occurs

In a baby, the brain is the delicate place where most of the functioning for the baby’s activity is centered. If the oxygen to the brain is disrupted during labor and delivery, a serious, permanent birth injury can result. Reducing the oxygen supply through the blood stream is one way of causing an injury or, sometimes, a physical injury, such as the use of forceps or pulling on a baby’s arm, can cause a birth injury.
